CBP Technicians Get Over $3.2 Million for Plant and Animal Work
Employees Impacted: Approximately 190 CBP Technicians performing plant-and-animal-related work.
In February 2018, NTEU and CBP reached a settlement that required CBP to pay Technicians appropriate premium pay for quarantine or inspectional work involving plants or animals. The agreement that NTEU negotiated called for CBP to issue back pay and interest to Technicians and provided for a claims process through which additional pay could be sought. In March 2018, CBP issued nearly $3 million in back pay to 153 current and former Technicians. Over the next three years, CBP paid another $348,000 to Technicians who filed claims. In April 2023, CBP granted nine requests from Technicians who were believed to have been overpaid premium pay during the grievance period, which concludes this matter.
NTEU Win Back Pay and Liquidated Damages for Employees Who Took Emergency Paid Leave:
1,850 employees who took emergency paid leave under the Families First Coronavirus Response Act.
NTEU allege CBP violated the Families First Coronavirus Response Act and the FLSA by refusing to include certain premium pay categories, such as night shift differentials, in an employee’s regular rate of pay when calculating pay for those who took emergency paid leave. In August 2020, CBP conceded that NTEU was correct, and that the agency had improperly calculated pay for certain employees who took emergency paid leave under the Act. In July 2021, NTEU and CBP reached agreement on the remedy to the 1,850 affected employees: back pay and liquidated damages equal to 90% of the back payments. In the fall of 2021, CBP issued over $580,000 to the employees.
